Privacy Policy

COLLECTION AND PROCESSING OF USER DATA 

Sociedade dos Vinhos Borges, S.A. (“SVB”) has made the site hosted at www.vinhosborges.pt (“Site”) available to its users (“User”). SVB is a public limited company that has its registered office at Rua Infante D. Henrique, 421-Apartado 21, 4436-909 Rio Tinto and is registered as legal person no. 500269394. SVB may ask the User to provide personal data, that is, information supplied by the User that may be used to identify or contact the same (“Personal Data”). Personal Data is requested when the User completes the message form on the contacts tab. In this case, the Personal Data that is collected and processed is the User’s name and email address.

SVB may use the data that the User provides to the site to furnish additional information that is deemed to be of interest to the User, namely product advertising, provided that the User has given their consent to the processing of their personal data. Pursuant to Decree-Law no. 7/2004, dated 7 January, the User will always be afforded the right to oppose this sending of additional information, by emailing SVB at politicaprivacidade@jmv.pt. Express consent will be given by means of selection of the option “I accept the processing of my personal data and the use of the same for promotional purposes".

TECHNICAL, ORGANIZATIONAL AND SECURITY MEASURES

In order to ensure the security of the User’s Personal Data and to maximize confidentiality, the information that is provided to us is processed in the strictest confidence and in accordance with our internal security and confidentiality policies and procedures, which are updated, as required, on a regular basis.
In determining the processing methods to be used, and during the processing itself, SVB undertakes to implement the technical and organizational measures necessary and appropriate to ensuring that the User’s Personal Data is fully protected and that such processing complies with all legal requirements.

RELEASING THE DATA TO THIRD PARTIES

SVB will not pass on any of the User’s personal data to third parties without proper authorisation from the User, except when authorities charged with enforcing the law or court rulings request SVB’s collaboration in identifying the User.

USER RIGHTS (DATA SUBJECTS)

The data subject is entitled to access any stored information free of charge and to request the restriction, correction, opposition or deletion of the same when, amongst other legal grounds, the contact information is not accurate or is no longer required for the purposes for which it was originally collected. The data subject is also entitled to withdraw their consent at any time, although this will not affect the legality of any processing that has already been carried out on the basis of consent that was given before this time.

DATA RETENTION

Contact information will be kept while it is needed for the processing purpose for which consent was given or until the User exercises their right of opposition, correction or deletion of the same.
BREACH OF PERSONAL DATA CONFIDENTIALITY If there is a breach of personal data confidentiality, and where the extent of a such a breach may put the User’s rights and freedoms at significant risk, SVB undertakes to inform the User of the breach within 72 hours of becoming aware of the same.

CHANGES TO THE PRIVACY POLICY

SVB reserves the right to change this Privacy Policy at any time. If changes are made to this Privacy Policy, the reference date for the most recent change, found at the top of this page, will also be updated. If the change is substantial, a notice will be published on the site.

LEGAL FRAMEWORK

The Privacy Policy and the collection, processing and sharing of the User's Personal Data are governed by the provisions of European Parliament and Council Regulation (EU) 2016/679, of 27 April 2016, and by the pertinent legislation and regulations in Portugal.
